Smoking Vehicles

Smoking vehicles produce emissions or smoke from the exhaust pipe, causing a very noticeable problem for air quality.  Vehicle engine aging and deterioration are usually the cause of such emissions.

Section 316.2935, Florida Statutes, addresses this problem by prohibiting any person from operating on Florida’s streets and highways a gasoline or diesel-powered vehicle that produces smoke from the exhaust pipe for a specified period of time under certain conditions.

Violation of this law could result in the driver being charged with a non-criminal traffic infraction by any law enforcement officer who observes the violation.
