What is the Florida Clean Marina Program?
Established in 2000, the Florida Clean Marina Program is a voluntary, non-regulatory designation
program that acknowledges and rewards environmentally conscious marine facilities. The Department
of Environmental Protection (DEP) and the Clean Boating Partnership work together to assist marine
facilities in implementing environmental Best Management
Practices that help protect and preserve Florida’s coast
and waterways.

Who administers the Clean Marina Program?
The Florida Department of Environmental Protection (DEP) administers the program as part of the
Office of Sustainable Initiatives.

What is the Clean Boating Partnership?
The Clean Boating Partnership is public/private partnership of marina and boatyard operators and
representatives from the Marine Industries Association of Florida and its local chapters; Florida
Sea Grant Program; United States Coast Guard Auxiliary and Sea Partners Program; Florida Fish and
Wildlife Conservation Commission; and DEP. This partnership provides assistance to and evaluation
of the program, as well as public outreach, workshops, technical assistance and mentoring.

What kind of facilities can participate in the Florida Clean Marina Program?
Marina: a dock or basin providing secure moorings for pleasure boats and often offering supply,
repair and other facilities.
Boatyard: a facility that provides a repair or refinishing site for hull, mechanical or electrical work on vessels. This work may entail the use of resins, paints, lubricants, solvents or other hazardous materials and may require an air permit, industrial waste water permit or stormwater permit for areas other than vehicular parking.
Marine Retailer: a facility that sells new or used boats and provides services for marine
vessels. Services may include onsite or offsite repair, refinishing, mechanical and/or electrical
work.

How does a facility become a Clean Marina, Clean Boatyard or
Clean Marine Retailer?
A facility must meet the environmental criteria outlined in the Florida
Clean Marina Program
Guidebook. The Guidebook contains information and comprehensive Action Plans for all three programs.
Once a facility has completed its Action Plan and satisfied the requirements, representatives from DEP and the
Clean Boating Partnership will do an on-site assessment to confirm. The results of the
assessment will be forwarded to the Program Manager and the facility will be notified of its
designation.

What are the criteria for designation?
Three categories of criteria are required for Clean Marina, Clean Boatyard or
Clean Marine Retailer
designation:
Environmental Management
- Compliance with environmental regulations and submerged land lease, and using
Best Management Practices determined from the self-assessment checklist and designation review.
- Available resource person at the marina to provide customers with environmental information, and
who can be contacted for inquires about the Clean Marina Program and environmental issues pertinent to
the marina.
- Adequate and well-managed trash/garbage and recycling containers.
- Post for viewing, or otherwise publish, a set of environmental policies used by the marina.
Marina Environmental Quality
- Water and land of the marina must be clean without signs of oil, sewage or litter.
- Marinas will encourage boaters not to discharge sewage into the waters of their facilities
or waters of the state.
- Raw sewage discharge is prohibited.
Services
- Marinas will provide clean restroom facilities and access to drinking water.
- Docks and grounds shall be well maintained for safety and appearance.
- All marina personnel are regularly trained on marina environmental policies and procedures.
- All Clean Marine Retailer facilities will provide environmental education at the time of sale of
new or used boats to the buyer. This education will consist of a “Welcome Boater Package” to be
provided by the facility.

- What if my facility doesn’t meet all the criteria?
Should facility owners/operators find, after completing the Action Plan, that the facility does not
meet all the applicable criteria, they have an opportunity to correct any “required” items on their
checklist. If further assistance is needed, the facility owner/operator may ask for technical
assistance from DEP or members of the Clean Boating
Partnership.

- How can a marina receive technical assistance?
It is possible that facility owners or operators may feel the need to obtain assistance in completing
the Action Plan checklist of operations. At the discretion of the facility owner/operator, one or
more of the following options may be used to obtain this assistance:
- Marine Industries Association of Florida: available consultant assistance from representatives of
MIAF throughout the state.
- Sea Grant: consultative assistance from the University of Florida Sea Grant Extension Service.
- United States Coast Guard (USCG): consultative assistance from the USCG, the USCG Auxiliary and USCG Sea Partners Program.
- Mentor: Assistance from a facility that has received its Designation and is willing to assist other
facilities in obtaining designation.
- Environmental Consultant: Engaged directly, or through an association, not-for-profit entity or other
non-regulatory organization to provide the services of an environmental consultant.

- How does a facility maintain its designation?
Facilities maintain their designation by submitting a self-assessment renewal on an annual basis, confirming
that they are continuing to meet Florida Clean Marina Program requirements.
DEP will send the renewal form each year at time of anniversary
date.

- Will the department use the action plan to start a regulatory investigation?
Consistent with DEP’s policy directive, DEP 922, April 1, 1996, Self Evaluation Policy, the DEP will not use
the Action Plan to initiate a civil investigation of or civil enforcement proceeding against the retailer or
any enforcement action with the following exception:
- The discovered violation resulted in serious actual harm, or may present imminent and substantial
endangerment to human health or the environment; or,
- The discovered violation involves the violations of a specific term of any judicial or administrative
order, or consent agreement.
Note: This policy does not apply to any deliberate and knowing acts or decisions made by any company or individual to violate the law.
