STATE OF FLORIDA
OFFICE OF THE GOVERNOR
EXECUTIVE ORDER NUMBER 05-148
WHEREAS, the Office of the Governor issued
Executive Order 05-139 on July 7, 2005, declaring the
existence of a state of emergency as a result and
consequence of the serious threat posed to the public
health, safety, and property in the State of Florida; and
WHEREAS, on July 10, 2005, Hurricane Dennis passed near
the Keys and West Coast of the State of Florida, made
landfall on the panhandle of the State of Florida, caused
millions of dollars worth of damage to property and rendered
homes and other buildings unsuitable for use and habitation;
and
WHEREAS, there exists a critical need to provide for the
roofing of homes and other buildings damaged or destroyed by
Hurricane Dennis; and
WHEREAS, the effects of Hurricane Dennis, alone and in
combination with the continuing recovery efforts from
Hurricanes Charley, Frances, Ivan and Jeanne, have
aggravated the critical need for roofing of homes and other
buildings damaged as a result of one or more of the
hurricanes in an expanded geographical area of the State of
Florida;
NOW, THEREFORE, I, JEB BUSH, as Governor of Florida, by
virtue of the authority vested in me by Article IV,
1(a) of the Florida Constitution and by the Florida
Emergency Management Act, as amended, and all other
applicable laws, do hereby promulgate the following
Executive Order, to take immediate effect:
Section 1. The provisions of Section 489.113(3), Florida
Statutes, are suspended to the extent that a certified or
registered general, building, or residential contractor is
not required to subcontract roofing work for the repair and
installation of roofs made of wood shakes, or asphalt or
fiberglass shingles.
Section 2. This Executive Order suspends the provisions
of Section 489.113(3), Florida Statutes, to the extent
provided in Section 1 in all counties in the State of
Florida.
Section 3. This Executive Order supersedes and replaces
the suspension of Section 489.113(3), Florida Statutes, by
Executive Orders 04-188, 04-197, 04-241, 05-56, and 05-103,
provided that all permits issued pursuant to the prior
Executive Orders shall be allowed to be completed.
Section 4. Pursuant to Section 252.36(2), Florida
Statutes, this Executive Order shall expire sixty (60) days
from the date hereof unless extended, provided that any work
not completed under permits issued pursuant to this
Executive Order may be finished notwithstanding the
expiration of this Executive Order.
IN TESTIMONY WHEREOF, I have hereunto set my hand and
caused the Great Seal of the State of Florida to be affixed,
at Tallahassee, the Capitol, this 19th day of July, 2005.
