Executive Order Number 06-204
(Emergency Management/Tropical Storm Ernesto)
WHEREAS, on August 27, 2006, as Hurricane Ernesto crossed the eastern portion of the Republic of Cuba, Executive Order 06-200 was promulgated declaring a state of emergency; and
WHEREAS, on August 28, 2006, Executive Order(s) 06-201 and 06-202 were issued authorizing the Secretary of State to activate the “Comprehensive Emergency Suspension Plan” because tropical storm conditions made it unsafe for residents of the state to travel to early voting polling locations and county governments to safely operate polling places; and
WHEREAS, Tropical Storm Ernesto has passed without substantial damage to property, personal injury, or disruption to early voting locations; and
WHEREAS, the conditions warranting a state of emergency have now ceased to exist; and
WHEREAS, the Governor finds that Executive Order(s) 06-201 and 06-202 are no longer necessary;
NOW, THEREFORE, I, JEB BUSH, as Governor of Florida, by virtue of the authority vested in me by Article IV, Section 1(a) of the Florida Constitution and by the Florida Emergency Management Act, as amended, and all other applicable laws, do hereby promulgate the following Executive Order, to take immediate effect:
Section 1. Executive Order(s) 06-201 and 06-202 are hereby terminated as of this date.
Section 2. Nothing in this Executive Order shall be construed to affect the validity of any action taken or obligation incurred in reliance upon Executive Order(s) 06-201 and 06-202 while they were in effect, nor shall anything in these Executive Order(s) be construed to affect the orderly completion of any emergency measures undertaken under the authority of Executive Order(s) 06-201 and 06-202.
