The Department gives
Notice of a Final Order adopting the Lower St. Johns River (LSJR)
Basin Management Action Plan (BMAP). The
LSJR BMAP identifies the management strategies necessary to achieve
the nutrient TMDLs for the main stem of the river from the confluence of
the Ocklawaha River north to the mouth of the river. The Final Order has
been assigned OGC Case No. 08-2428.

- Part 1, Part 2 and Part 3 of the BMAP document is now available in either PDF
(Adobe Acrobat) or Microsoft Word format.
If you have specific
comments or corrections, please use “track changes” on the Word
version to submit your comments. Note that Part 2 of the document
will be posted on the same site at the end of October and Part 3
(the final portion) will be posted in November.
- EPA proposed a new TMDL on September 30th with a public comment
period until November 30th. You are strongly encouraged to review
the TMDL language and specific allocations to ensure they are
correct at: http://www.epa.gov/region4/water/tmdl/florida. Comments
can be submitted directly to U.S. EPA. We would appreciate it if you
would copy
Daryll Joyner (Daryll.joyner@dep.state.fl.us) and
Tiffany
Busby (tlbusby@wildwoodconsulting.net) with any comments/corrections
you suggest to EPA so we can address them in the State’s proposed
TMDL and BMAP.
- There are preliminary findings from the Federal Court pertaining
to the suit over the rule change related to creating site specific
alternative criterion (SSAC) and the specific SSAC created for
dissolved oxygen in the LSJ main stem are attached in PDF format.
Please note the following preamble from Daryll Joyner:
“The
Department recently received a ruling (attached) from the US
District Court/Northern District of Florida, Tallahassee
Division regarding the Riverkeeper’s Challenge to Florida’s Type
II Site-Specific Alternative Criterion (SSAC) Provision. Judge
Mickle entered an Order on 9/28 denying the Plaintiffs' Motion
for Preliminary Injunction because
- a) the Plaintiffs' did not demonstrate a substantial likelihood of
success on merits, and did not show they will suffer irreparable injury
if the injunction is not granted, and
- b) EPA’s approval of the Type II SSAC rule is consistent with its
duty under 33 U.S.C. § 1313(c) to ensure that the state’s water quality
criteria are “scientifically defensible and protective of designated
uses.”
Judge Mickle also denied the intervenors (including the Department)
motions to intervene finding that EPA could adequately represent
everyone's interest since every movant wants the same relief that EPA
wants.”
