Florida Statutes Regarding Recycling
Section 366.91: this section contains the definition of renewable energy. This is important because the 75% recycling goal includes any "solid waste used for the production of renewable energy." What is defined as renewable energy can have a major impact on reaching the goal.
Section 403.703: this section includes various definitions dealing with solid waste and recycling.
Section 403.7032: this new section, effective in 2008, contains the 75% recycling goal and the program components DEP must deliver to the Legislature by January, 2010.
Section 403.706: this section contains the first set of recycling goals passed by the Legislature in 1988. Those goals have been modified somewhat during the years since then. Most recently, the 2008 Legislative session revised a segment dealing with compost in sub-section (2) (d).
Also, the goals are for municipal solid waste (MSW). MSW is a sub-set of all solid waste and is defined in sub-section (5) as specifically excluding sludge as well as waste from industrial, mining, and agricultural operations. The goals remain in effect presumably until the Legislature receives and acts on DEP's 75% recycling goal recommendations in 2010.
Section 1000.08: this new section, effective in 2008, directs DEP and the Department of Education to develop an awards or recognition program for green accomplishments in schools. This will be coordinated with the development of a couple of the 75% recycling goal components that DEP must deliver to the Legislature by January, 2010. Those components deal with education and recognition programs for recycling efforts.
